Terms of Service: AACBE National Web Platform

Welcome to the Asian American College Board of Excellence (AACBE). By accessing or using aaexcellence.org (the “Platform”), which includes the “Luminaries” career inspiration directory (the “Luminaries CMS”) and the secure scholarship application portal (referred to as “The Vault”), you agree to be bound by these Terms of Service.

1. Eligibility

To qualify for the AACBE Scholarship Vault, applicants must meet the following criteria:

• Identity: Must identify as Asian American.
• Academic Standing: Must be a high school junior or senior.
• Location: Must be located within the United States, including Puerto Rico.
• Intended Use: Scholarships must be intended for use at an accredited college or university.

While AACBE utilizes a Rolling Review process for applications, we reserve the right to verify eligibility and disqualify any applicant who provides fraudulent information or does not meet these specified requirements.

2. Intellectual Property & Proprietary Rights

• The Platform: The Platform’s design, structure, and “Generational Asset Scoring Matrix” are the proprietary intellectual property of Data With Style LLC.
• The Custom Build: The Platform was custom engineered by Luma Creative.
• Original Content: All original text, unique biographies, and proprietary graphics are owned by AACBE.
• Third-Party Media: AACBE profiles “Luminaries” for educational and career-inspiration purposes. Images, videos, and trademarks of these individuals or entities are the property of their respective owners and are used on the Platform for informational, transformative, or educational purposes. AACBE does not claim ownership of third-party media hosted on the Platform.
• Usage Restrictions: You may not scrape, reproduce, or redistribute any portion of the Platform content—whether proprietary or third-party—without express written consent from the respective owners.

3. “The Vault” Security & Anti-Scraping

AACBE provides “The Vault” as a secure infrastructure to protect applicant intellectual property.

• Anti-AI/LLM Clause: Use of any automated system, including “robots,” “spiders,” or “offline readers,” to access the Platform for the purpose of training Large Language Models (LLMs) or AI scraping is strictly prohibited.
• Data Integrity: You agree not to attempt to breach the security layers of The Vault or interfere with the Platform’s technical infrastructure.

4. Redefining Impact & No Guarantee

AACBE is dedicated to redefining impact through a holistic review process. While we utilize the Generational Asset Scoring Matrix to evaluate executive stewardship and lived experience, the submission of an application does not guarantee a scholarship award. All decisions made by the AACBE Selection Committee are final and at the sole discretion of the organization.

5. Prohibited Conduct

Users agree not to:

• Post or transmit any content that is defamatory, offensive, or infringing on third-party rights.
• Impersonate any person or entity, including AACBE staff or Luminaries.
• Use the Platform for any unauthorized commercial purposes.

6. Limitation of Liability

To the maximum extent permitted by law, AACBE, Data With Style LLC, and Luma Creative shall not be liable for any indirect, incidental, or consequential damages resulting from your use of the Platform or your participation in the scholarship application process.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, without regard to its conflict of law provisions.
